Artículo 1 — Disposiciones Generales y Definiciones

Estos Términos y Condiciones (en adelante, los "Términos") regulan la relación jurídica entre Lefebre Subastas S.A.S. (en adelante, "Lefebre Subastas" o "la Casa") y toda persona natural o jurídica que participe, de forma presencial, telefónica o en línea, en cualquiera de las subastas organizadas por Lefebre Subastas. La participación en una subasta constituye la aceptación plena, expresa e incondicional de estos Términos en su versión vigente.

Para efectos de estos Términos, se adoptan las siguientes definiciones:

Casa de Subastas / Lefebre Subastas: Lefebre Subastas S.A.S., empresa legalmente constituida bajo las leyes de la República de Colombia.
Comprador / Postor: Persona natural o jurídica que participa en la subasta con la intención de adquirir lotes.
Lote: Bien o conjunto de bienes ofrecidos como una unidad en la subasta.
Precio de Martillo / Precio de Adjudicación: Suma más alta aceptada por el subastador al momento de cerrar la puja sobre un lote.
Comisión del Comprador: Comisión cobrada al Comprador sobre el Precio de Martillo.
Precio de salida/estimado: Rango orientativo del valor esperado de un lote, publicado en el catálogo.
Subasta en Línea: Modalidad de subasta celebrada a través de la plataforma digital de Lefebre Subastas.

Artículo 2 — Registro y Habilitación para Participar

2.1 Registro obligatorio

Para participar en cualquier subasta de Lefebre Subastas es obligatorio registrarse previamente. El registro podrá realizarse de forma presencial en nuestras instalaciones, a través del sitio web www.lefebresubastas.com y en las plataformas habilitadas para la participación en línea Lefebre Subastas, la cual podrá ser descargada en su versión móvil en Apple Store y Google Play y la plataforma Invaluable.com.

2.2 Documentación requerida

Para personas naturales:

Cédula de ciudadanía o pasaporte vigente.
Datos de contacto completos (dirección, teléfono, correo electrónico).

Para personas jurídicas:

Certificado de existencia y representación legal vigente (no mayor a 30 días).
RUT actualizado.
Documento de identidad del representante legal.
Poder notariado cuando actúe un apoderado.

2.3 Garantía o depósito

Lefebre Subastas podrá exigir, a su entera discreción, un depósito de garantía antes de autorizar la participación. Dicho depósito será devuelto íntegramente al Postor que no resulte adjudicatario de ningún lote, en un plazo no mayor a cinco (5) días hábiles.

2.4 Derecho de admisión

Lefebre Subastas se reserva el derecho de rechazar solicitudes de registro o de revocar la habilitación de un Postor sin necesidad de expresar causa justificada.

Artículo 3 — Catálogo y Descripción de Lotes

Lefebre Subastas publica un catálogo impreso y/o digital con la descripción de los lotes disponibles para la venta. Las descripciones reflejan la opinión de especialistas de la Casa y tienen carácter meramente orientativo.

Lefebre Subastas indicará cuáles lotes cuentan con un certificado de autenticidad emitido por el artista o por terceros, sin hacerse responsable por la opinión o certificación emitida en dicho documento.

La Casa no garantiza la exactitud ni la integridad de las descripciones. Los postores son plenamente responsables de examinar los lotes de forma personal durante el período de exposición previa a la subasta, el cual se anunciará oportunamente.

Los lotes se venden en el estado en que se encuentran al momento de la adjudicación. Toda modificación de las características de un lote, notificada antes o durante la subasta, prevalecerá sobre la descripción del catálogo.

Artículo 4 — Estimaciones y Precios de Salida

Las estimaciones publicadas en el catálogo son aproximaciones del valor comercial esperado del lote y no constituyen garantía de precio. Se establecen como precios de salida con el cual se da inicio a las pujas.

El Precio de Salida podrá variar al momento de iniciar la subasta cuando existan pujas previas registradas en la casa de subastas que superen el valor base del precio inicialmente publicado.

Artículo 5 — Proceso de Puja y Desarrollo de la Subasta

5.1 Dirección de la subasta

El subastador dirige la venta a su exclusiva discreción. Sus decisiones son definitivas en todo lo relacionado con el desarrollo de la subasta, incluyendo la aceptación o rechazo de pujas, la retirada de lotes y la resolución de disputas durante el evento.

5.2 Incrementos de puja

Los incrementos de puja siguen una tabla establecida por la Casa, la cual podrá modificarse a discreción del subastador durante el transcurso del evento:

5.3 Pujas del subastador

El subastador podrá abrir la puja de un lote con un valor superior al publicado como precio de salida en el catálogo, cuando existan pujas previas registradas por escrito en la casa de subastas.

5.4 Adjudicación

El golpe de martillo constituye la aceptación de la puja más alta y perfecciona el contrato de compraventa entre el Comprador y Lefebre Subastas.

5.5 Disputas durante la subasta

Si surgiera alguna disputa respecto a la adjudicación de un lote, el subastador podrá, a su exclusiva discreción, volver a subastar el lote en el mismo acto. La decisión del subastador será definitiva e inapelable.

Artículo 6 — Modalidades de Participación

6.1 Participación presencial

El Postor inscrito podrá participar personalmente en la sala de subastas. Se le asignará un número de paleta que deberá exhibir de forma clara para realizar sus pujas.

6.2 Puja por ausente (oferta por escrito)

El Postor que no pueda asistir podrá presentar una puja máxima por escrito, que deberá ser recibida desde el día de inicio de la exposición de la subasta, hasta mínimo dos (2) horas antes del inicio de la sesión. La Casa ejecutará la puja en nombre del Postor al menor precio posible, hasta el límite de puja autorizado. En caso de empate entre dos pujas por ausente, tendrá prioridad la que se haya recibido con antelación; las pujas escritas tendrán prioridad sobre las pujas realizadas en sala.

6.3 Puja telefónica

Será realizada, previa solicitud del Postor con al menos veinticuatro (24) horas de antelación. La Casa se comunicará con el Postor por medio de uno de sus representantes al momento de ser abierto el lote para que realice sus pujas en tiempo real. La Casa no asume responsabilidad sobre la adjudicación del lote por falta de respuesta del postor; en caso de falta de respuesta a la llamada telefónica, el representante solo defenderá el lote hasta el valor límite de la puja previamente registrada, y en caso de adjudicarse se dará comunicación al día siguiente.

6.4 Puja en línea

Los Postores habilitados podrán participar a través de las plataformas digitales habilitadas para cada subasta.

Artículo 7 — Comisión del Comprador y Cargos Adicionales

Lefebre Subastas cobrará un 23% adicional sobre el valor final del martillo (IVA incluido).

Artículo 8 — Obligaciones del Comprador

El Comprador adjudicatario estará obligado a:

Efectuar el pago íntegro del precio total (Precio de Martillo + comisión) dentro de los cinco (5) días hábiles siguientes a la adjudicación. En caso de no ser pagado en este lapso de tiempo, la casa se reserva el derecho de cobrar intereses de mora sobre los saldos insolutos al máximo permitido por la ley.
Retirar el lote adjudicado dentro de los diez (10) días calendario siguientes a la confirmación del pago total. En caso de no ser retirado, la casa se reserva el derecho de aplicar cobro por bodegaje de $50.000 diarios por lote, los cuales deberán ser cancelados al retiro de la obra.
Cubrir todos los costos de embalaje, transporte, seguros y cualquier impuesto de exportación o importación que corresponda. (Lefebre no se hace responsable de la exportación o consecución de permisos de exportación de ninguno de los lotes adjudicados.)
Proporcionar información veraz y actualizada durante el proceso de registro.
Cumplir con todas las normas de exportación e importación aplicables a los bienes adquiridos.

Artículo 9 — Pago

9.1 Plazo y moneda

El pago total deberá realizarse dentro de los cinco (5) días hábiles siguientes a la adjudicación. Los pagos se recibirán en pesos colombianos (COP). Para compradores internacionales, los pagos en divisa extranjera se liquidarán a la tasa de la institución financiera receptora vigente en la fecha del pago.

9.2 Medios de pago aceptados

Transferencia bancaria a las cuentas designadas por Lefebre Subastas.
Cheques a nombre de Lefebre Subastas S.A.S.
Tarjeta de crédito o débito; las comisiones bancarias aplicadas a las tarjetas de crédito serán asumidas por el comprador.
Efectivo.

9.3 Incumplimiento de pago

En caso de mora o incumplimiento del pago, Lefebre Subastas podrá, a su entera discreción:

Cobrar intereses de mora a la tasa máxima legal colombiana desde la fecha de vencimiento.
Resolver la adjudicación y volver a ofrecer el lote en subasta o venta privada.
Exigir al Comprador el pago de los perjuicios derivados del incumplimiento, incluyendo las comisiones adeudadas, la diferencia entre el precio original de adjudicación y el precio obtenido en la adjudicación y el costo de bodegaje.
Inhabilitar al Comprador para participar en futuras subastas de Lefebre Subastas.
Iniciar las acciones judiciales correspondientes.

Artículo 10 — Retiro e Importación / Exportación

El Comprador deberá retirar los lotes adjudicados dentro de los diez (10) días calendario siguientes a la confirmación de pago.

El Comprador es responsable de obtener todas las licencias, permisos y autorizaciones requeridas por las autoridades colombianas y del país de destino para la exportación e importación de los bienes. Lefebre Subastas no asume responsabilidad alguna por demoras o impedimentos aduaneros.

Para bienes sujetos al régimen de Patrimonio Cultural de la Nación (Ley 397 de 1997 y normas concordantes), el Comprador deberá tramitar los permisos correspondientes ante el Ministerio de las Culturas, las Artes y los Saberes.

Artículo 11 — Responsabilidad por el Lote

Lefebre Subastas mantendrá el seguro todo riesgo sobre el lote adjudicado durante 10 días calendario siguientes a la confirmación de pago. Los lotes no retirados en dicho plazo generarán cargos de almacenamiento por valor de $50.000 por lote por día.

Lefebre Subastas conservará los lotes adjudicados y no retirados con la diligencia de un depositario ordinario, sin asumir responsabilidad por caso fortuito o fuerza mayor.

Artículo 12 — Autenticidad, Condición y Devoluciones

12.1 Garantía de autenticidad

Lefebre Subastas garantiza la autenticidad de los lotes tal como se describen en el catálogo durante un período de seis (6) meses a partir de la fecha de venta, siempre que el Comprador demuestre, mediante dictamen pericial independiente reconocido, que el lote es una falsificación material que no corresponde a la descripción del catálogo.

12.2 Exclusiones

La garantía de autenticidad no aplica cuando:

La descripción del catálogo identifique la obra como "atribuida al artista".
Esté claramente descrita como copia o reproducción dentro del catálogo.
El lote haya sido restaurado, alterado o intervenido por el Comprador o un tercero con posterioridad a la venta.
La reclamación se base únicamente en un cambio de opinión estilística o atribución posterior.

12.3 Condición de los lotes

Los lotes se venden en el estado en que se encuentran. Los reportes de condición disponibles tienen carácter orientativo y no constituyen garantía. El examen personal durante la exposición previa es responsabilidad exclusiva del Comprador.

12.4 Devoluciones

Fuera del supuesto de autenticidad descrito en el numeral 12.1, Lefebre Subastas no aceptará devoluciones. El Estatuto del Consumidor colombiano (Ley 1480 de 2011) se aplicará en los casos y términos que corresponda.

Artículo 13 — Subasta en Línea

Las subastas en línea de Lefebre Subastas se rigen por estos Términos y por las condiciones específicas de la plataforma digital, las cuales se incorporan por referencia:

El Postor en línea asume los riesgos propios de la conectividad a internet. Lefebre Subastas no es responsable por desconexiones, retrasos o fallas técnicas.
La puja en línea tendrá el mismo valor vinculante que una puja presencial. El Postor en línea acepta que su oferta constituye una obligación de compra.
La plataforma utiliza sistemas de seguridad estándar de la industria (encriptación SSL/TLS), pero no garantiza la absoluta inviolabilidad del sistema.
Las pujas en línea cierran en la hora anunciada para cada lote. En caso de puja de último segundo, podrá activarse una extensión automática de 15 segundos por lote.
El Postor en línea es responsable de mantener confidenciales sus credenciales de acceso. Cualquier puja realizada con sus credenciales se considerará vinculante.

Artículo 14 — Privacidad y Protección de Datos Personales

Lefebre Subastas trata los datos personales de sus clientes en cumplimiento de la Ley Estatutaria 1581 de 2012, el Decreto 1377 de 2013 y demás normas concordantes sobre protección de datos personales en Colombia.

Los datos personales recopilados serán utilizados exclusivamente para:

La gestión y ejecución de la relación comercial derivada de la subasta.
El envío de catálogos, invitaciones y comunicaciones relacionadas con las actividades de Lefebre Subastas, previa autorización del titular.
El cumplimiento de obligaciones legales y regulatorias.

El titular de los datos podrá ejercer los derechos de acceso, corrección, supresión, revocación y portabilidad enviando una solicitud escrita al correo info@lefebresubastas.com. La Política de Privacidad completa se encuentra disponible en www.lefebresubastas.com.

Artículo 15 — Propiedad Intelectual

Todo el contenido del catálogo, el sitio web, fotografías, textos y demás materiales producidos por Lefebre Subastas son de su exclusiva propiedad o han sido debidamente licenciados, y están protegidos por las leyes de propiedad intelectual de Colombia y los tratados internacionales aplicables.

Queda prohibida la reproducción, distribución o uso comercial de dichos materiales sin autorización escrita previa de Lefebre Subastas.

Artículo 16 — Limitación de Responsabilidad

En la máxima medida permitida por la ley colombiana, Lefebre Subastas no será responsable por:

Daños indirectos, incidentales, especiales o consecuenciales derivados de la subasta o del uso de su plataforma en línea.
Errores tipográficos, de descripción o de estimación en el catálogo, cuando obedezcan a causas ajenas al control razonable de la Casa.
Fallas en los sistemas de telecomunicaciones que impidan la participación telefónica o en línea.
Actos u omisiones de terceros proveedores de servicios logísticos, de transporte o de almacenamiento.

La responsabilidad total de Lefebre Subastas frente a cualquier reclamación no excederá, en ningún caso, el monto equivalente a la comisión del Comprador efectivamente pagada por el lote objeto de la reclamación.

Artículo 17 — Ley Aplicable y Resolución de Disputas

Estos Términos se rigen e interpretan conforme a las leyes de la República de Colombia. Cualquier controversia derivada de o relacionada con estos Términos o con las subastas de Lefebre Subastas se resolverá mediante el siguiente mecanismo escalonado:

Negociación directa entre las partes durante un período máximo de treinta (30) días calendario desde la notificación de la controversia.
Conciliación ante el Centro de Arbitraje y Conciliación de la Cámara de Comercio de Bogotá, si la negociación directa fracasa.
Arbitraje institucional ante el Centro de Arbitraje y Conciliación de la Cámara de Comercio de Bogotá, mediante un (1) árbitro, aplicando el Reglamento de dicho Centro, en idioma castellano y con sede en Bogotá D.C.

Sin perjuicio de lo anterior, cualquiera de las partes podrá acudir a la justicia ordinaria colombiana para solicitar medidas cautelares urgentes.

Artículo 18 — Modificaciones a los Términos

Lefebre Subastas se reserva el derecho de modificar estos Términos en cualquier momento. Las modificaciones se publicarán en el sitio web www.lefebresubastas.com, con un mínimo de quince (15) días de anticipación a su entrada en vigor y se notificarán por correo electrónico a los Postores registrados.

La participación en una subasta posterior a la publicación de las modificaciones implicará la aceptación tácita de los nuevos Términos.

Artículo 19 — Disposiciones Finales

Si alguna disposición de estos Términos fuera declarada nula, inválida o inaplicable por autoridad competente, las demás disposiciones permanecerán en plena vigencia.

La omisión de Lefebre Subastas en exigir el cumplimiento estricto de cualquier disposición de estos Términos no constituye renuncia a dicho cumplimiento en el futuro.

Estos Términos constituyen el acuerdo íntegro entre las partes respecto a su objeto y reemplazan cualquier acuerdo previo, verbal o escrito, sobre las mismas materias.

Para constancia de lo anterior, Lefebre Subastas S.A.S. publica y pone en vigencia los presentes Términos y Condiciones a partir del 5 de mayo de 2026.

Article 1 — General Terms and Conditions

These Terms and Conditions (hereinafter, the "Terms") govern the legal relationship between Lefebre Subastas S.A.S. (hereinafter, "Lefebre Subastas" or "the House") and any individual or legal entity participating, in person, by telephone, or online, in any of the auctions organized by Lefebre Subastas. Participation in any auction constitutes complete, total, and unconditional acceptance of these Terms and Conditions in their current version.

For the purposes of these Terms, the following definitions are adopted:

Auction House / Lefebre Subastas: Lefebre Subastas S.A.S., a company legally incorporated under the laws of the Republic of Colombia.
Buyer / Bidder: Any person or entity participating in any auction with the intention of acquiring lots.
Lot: Property or group of properties offered as a unit in the auction.
Hammer Price / Purchase Price: The highest amount accepted by the auctioneer at the moment of closing the bidding on a lot.
Buyer's Premium: Commission or fee to be paid by the Buyer in addition to the Hammer Price.
Starting price/estimate: Indicative range of the expected value of a lot, published in the catalog.
Online Auction: Auction conducted through Lefebre Subastas' digital platform.

Article 2 — Registration and Eligibility to Participation

2.1 Mandatory registration

To participate in any auction conducted by Lefebre Subastas, a prior registration is mandatory. Registration may be completed in person at our facilities, on our website www.lefebresubastas.com and on the enabled online platforms — Lefebre Subastas —, which can be downloaded in its mobile version from Apple Store, Google Play or Invaluable (www.invaluable.com).

2.2 Required documentation

For individuals:

I.D. card or valid passport.
Complete contact information (address, telephone number, email address).

For legal entities:

Valid certificate of incorporation (issued no more than 30 days prior).
Tax registration (RUT in Colombia).
Identity document of the legal representative.
Notarized power of attorney when acting through a third person.

2.3 Guarantee or deposit

Lefebre Subastas may require, at its sole discretion, a security deposit in order to allow any Bidder to participate in an Auction. Such deposit shall be fully refunded to any Bidder which is not awarded a lot, within a five (5) business days period.

2.4 Right of admission

Lefebre Subastas reserves the right to reject any Bidder or registration request or revoke a Bidder's authorization without the need to justify its decision.

Article 3 — Cataloguing and Lot Descripción

Lefebre Subastas publishes a printed and/or digital catalog version of the Auction containing the description of the lots available for sale. The descriptions reflect the opinion of the House's specialists and are merely indicative in nature.

Lefebre Subastas shall indicate which lots have a certificate of authenticity issued by the artist or by a third party, without assuming any responsibility for the opinion or certification stated in such a document.

The House does not guarantee the accuracy or completeness of the descriptions. Bidders are fully responsible for personally examining the lots during the exhibition period prior to the auction, whose dates will be announced beforehand.

The lots are sold in the condition in which they are found at the time of award. Any modification to the characteristics of a lot, notified before or during the auction, shall prevail over the description in the catalog.

Article 4 — Estimates and Precio inicials

The estimates published in the catalog are approximations of the expected commercial value of the lot and do not constitute a price guarantee. These are set as the Precio inicials from which bidding begins.

The Precio inicial may vary at the start of the auction whenever there are prior bids registered with the auction house that exceed the initial published Precio inicial.

Article 5 — Bidding Process and Conduct of the Auction

5.1 Auction Process

The auctioneer conducts the sale at his or her sole discretion. The auctioneer's decisions are final in all matters related to the auction process, including the acceptance or rejection of bids, the withdrawal of lots, and the resolution of disputes during the event.

5.2 Bid increments

Bid increments follow a schedule established by the House, which may be modified at the auctioneer's discretion during the course of the event:

5.3 Auctioneer bids

The auctioneer may open the bidding on any lot at a value higher than the starting price published in the catalog, whenever there are prior bids registered in writing with the House.

5.4 Awarding

The fall of the hammer constitutes the acceptance of the highest bid and executes the purchase and sale agreement between the Buyer and Lefebre Subastas.

5.5 Disputes arising during the auction

Should any dispute arise regarding the award of a lot, the auctioneer may, at his or her sole discretion, reoffer the lot for auction during the same event. The auctioneer's decision shall be final and unappealable.

Article 6 — Participation Methods

6.1 In-person participation

The registered Bidder may participate personally in the auction room. A paddle number shall be assigned, which must be clearly displayed in order to place bids.

6.2 Absentee bidding (written bid)

A Bidder unable to attend may submit a maximum written bid, which must be received from the first day of the opening of the auction exhibition up until at least two (2) hours before the beginning of the auction. The House shall execute the bid on behalf of the Bidder at the lowest possible price, up to the authorized bidding limit. In the event of a tie between two absentee bids, priority shall be given to the one received first; written bids shall have priority over bids made in the room.

6.3 Telephone bidding

Shall be carried out at any Bidder's request if made at least twenty-four (24) hours in advance. A House representative shall contact the Bidder at the moment the lot is opened for bidding so that the Bidder may place bids in real time. The House assumes no responsibility for any lot awarding due to a lack of response from the bidder; in the event of no response to the telephone call, the representative shall bid on the lot only up to the maximum value of the previously registered bid, and if awarded, communication shall be addressed to the Bidder on the following day.

6.4 Online bidding

Authorized Bidders may participate through the enabled digital platforms at each auction.

Article 7 — Buyer's Premium and Additional Charges

Lefebre Subastas shall charge an additional 23% on top of the final hammer price (VAT included).

Article 8 — Buyer's Obligations

The successful Buyer shall be obliged to:

Make full payment of the total price (Hammer Price + buyer's premium) within five (5) business days following awarding. If payment is not made within this period, the House reserves the right to charge default interest on any outstanding balances at the maximum rate permitted by law.
Remove the awarded lot within ten (10) calendar days following confirmation of full payment. If not removed, the House reserves the right to apply a storage charge of $50,000 per day per lot, which must be paid upon collection of the lot.
Cover all costs of packaging, transportation, insurance, and any applicable export or import taxes. (Lefebre is not responsible for obtaining export permits for any of the awarded lots.)
Provide accurate, truthful and updated information during the registration process.
Comply with all export and import regulations applicable to the acquired goods.

Article 9 — Payment

9.1 Payment Terms and currency

Full payment must be made within five (5) business days following awarding. Payments shall be received in Colombian pesos (COP). For international buyers, payments in foreign currency shall be settled at the prevailing exchange rate applied by the House financial institution in effect on the date of payment.

9.2 Accepted payment methods

Bank transfer to the accounts designated by Lefebre Subastas.
Checks payable to Lefebre Subastas S.A.S.
Credit or debit card. Any bank commissions applied to credit cards shall be assumed by the buyer.
Cash.

9.3 Failure to pay

In the event of delay or failure of payment, Lefebre Subastas may, at its sole discretion:

Charge default interest at the maximum Colombian legal rate from the due date.
Cancel the awarding and reoffer the lot at auction or private sale.
Require the Buyer to pay damages arising from the breach, including unpaid commissions, the difference between the original awarding price and the price obtained in the subsequent auction or private sale, plus storage costs.
Disqualify the Buyer from participating in future Lefebre Subastas auctions.
Initiate the corresponding legal actions.

Article 10 — Collection and Import / Export

The Buyer must collect the awarded lots within ten (10) calendar days following payment confirmation.

The Buyer is responsible for obtaining all licenses, permits, and authorizations required from the Colombian authorities and the destination country's authorities for the export and import of such goods. Lefebre Subastas assumes no responsibility for customs delays or impediments.

For goods subject to the National Cultural Heritage regime (Law 397 of 1997 and concordant regulations), the Buyer must process the corresponding permits from the Ministry of Cultures, Arts and Knowledge.

Article 11 — Responsibility for the Lot

Lefebre Subastas shall maintain all-risk insurance on the awarded lot during the 10 calendar days following payment confirmation. Lots not collected within said period shall incur storage charges in the amount of $50,000 per lot per day.

Lefebre Subastas shall keep awarded and uncollected lots with the due diligence owed to an ordinary depositor, without assuming any liability for fortuitous events or force majeure.

Article 12 — Authenticity, Condition, and Returns

12.1 Authenticity guarantee

Lefebre Subastas guarantees the authenticity of the lots as described in the catalog for a period of six (6) months from the date of sale, provided that the Buyer demonstrates, through a recognized independent expert opinion, that the lot is a material forgery that does not correspond to the catalog description.

12.2 Exclusions

The authenticity guarantee shall not apply when:

The catalog description identifies the work as "attributed to the artist".
It is clearly described as a copy or reproduction in the catalog.
The lot has been restored, altered, or intervened by the Buyer or a third party after the sale.
The claim is based solely on a post-auction change of stylistic opinion or attribution.

12.3 Condition of the lots

The lots are sold in the condition in which they are. Available condition reports are indicative in nature and do not constitute a guarantee. Personal examination during the prior exhibition period is the sole responsibility of the Buyer.

12.4 Returns

Except for the authenticity scenario described in section 12.1, Lefebre Subastas shall not accept returns. The Colombian Consumer Protection Statute (Law 1480 of 2011) shall apply in the cases and terms where appropriate.

Article 13 — Online Auction

Lefebre Subastas online auctions are governed by these Terms and Conditions and by the specific conditions of the digital platforms, which are incorporated herein as a reference:

The online Bidder assumes the risks inherent to the internet connectivity. Lefebre Subastas is not responsible for disconnections, delays, or technical failures.
Online bidding shall have the same binding effect as in-person bidding. The online Bidder accepts that his or her offer constitutes an obligation to purchase.
The platform uses industry-standard security systems (SSL/TLS encryption), but does not guarantee the absolute inviolability of the system.
Online bidding closes at the announced time for each lot. In the event of a last-second bid, an automatic extension of 15 seconds per lot may be activated.
The online Bidder is responsible for maintaining the confidentiality of access credentials and passwords. Any bid placed using such credentials or passwords shall be considered binding.

Article 14 — Privacy and Personal Data Protection

Lefebre Subastas keeps the personal data of its clients in compliance with Statutory Law 1581 of 2012, Decree 1377 of 2013, and other concordant regulations regarding personal data protection in Colombia.

The personal data collected shall be used exclusively for:

The management and execution of the commercial relationship arising from the auction.
The sending of catalogs, invitations, and communications related to Lefebre Subastas activities, subject to prior authorization from the Bidder.
Compliance with legal and regulatory obligations.

The Bidder may exercise the rights of access, correction, deletion, revocation, and portability by sending a written request to the email info@lefebresubastas.com. The complete Privacy Policy is available at www.lefebresubastas.com.

Article 15 — Intellectual Property

All content of the catalog, website, photographs, texts, and other materials produced by Lefebre Subastas are its exclusive property or have been duly licensed, and are protected by Colombian intellectual property laws and applicable international treaties.

The reproduction, distribution, or commercial use of said materials without prior written authorization from Lefebre Subastas is prohibited.

Article 16 — Liability Limitation

To the fullest extent permitted by Colombian law, Lefebre Subastas shall not be liable for:

Indirect, incidental, special, or consequential damages arising from the auction or the use of its online platforms.
Typographical, description, or estimation errors in the catalog, when caused by circumstances beyond the reasonable control of the House.
Outages in the telecommunications systems that prevent telephone or online participation.
Acts or omissions of third-party logistics providers, transportation, or storage services.

The total liability of Lefebre Subastas with respect to any claim shall in no event exceed the amount equivalent to the Buyer's Premium effectively paid for the lot subject to the claim.

Article 17 — Applicable Law and Dispute Resolution

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Colombia. Any controversy arising out of or related to these Terms and Conditions or to Lefebre Subastas auctions shall be resolved through the following stepped mechanism:

Direct negotiation between the parties during a maximum period of thirty (30) calendar days from notification of the controversy.
Conciliation before the Arbitration and Conciliation Center of the Bogotá Chamber of Commerce, if direct negotiation fails.
Institutional arbitration before the Arbitration and Conciliation Center of the Bogotá Chamber of Commerce, by means of one (1) arbitrator, applying the Rules of said Center, in Spanish and based in Bogotá D.C.

Notwithstanding the foregoing, either party may resort to the ordinary Colombian courts to request urgent precautionary measures.

Article 18 — Modifications to the Terms and Conditions

Lefebre Subastas reserves the right to modify these Terms and Conditions at any time. Modifications shall be published on the website www.lefebresubastas.com, with a minimum of fifteen (15) days prior notice before their enforcement and shall be notified by email to registered Bidders.

Participation in any auction after publication of the modifications shall imply the tacit acceptance of the new Terms and Conditions.

Article 19 — Final Provisions

If any provision of these Terms is declared null, invalid, or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect.

The failure by Lefebre Subastas to enforce full and strict compliance with any provision of these Terms and Conditions shall not constitute a waiver of such compliance in the future.

These Terms and Conditions constitute the entire agreement between the parties regarding their subject matter and replace any prior agreement, verbal or written, on the same matters.

In witness whereof, Lefebre Subastas S.A.S. publishes and puts into effect these Terms and Conditions as of May 5, 2026.
